Terms of Use

These Terms of Use ("Terms") govern your access to and use of the ARK Fire RMS software platform ("Services") provided by ARK Enterprises LLC ("ARK," "we," "us," or "our"). These Terms apply to you as an individual user who has been granted access to the Services by your fire department or organization ("Your Organization").
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Services.
1. Acceptance of Terms
1.1 Agreement
By clicking "I Accept," creating an account, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1.2 Authority
You represent that you are at least 18 years old and have been authorized by Your Organization to use the Services. Your use of the Services is also subject to any agreement between Your Organization and ARK Fire RMS.
1.3 Conflicts
If there is a conflict between these Terms and the Master Subscription Agreement between Your Organization and ARK Fire RMS, the Master Subscription Agreement will control to the extent of the conflict.
2. Your Account
2.1 Account Creation
Your account is created by an administrator at Your Organization. You are responsible for maintaining the accuracy of your account information.
2.2 Account Security
You are responsible for:
- Keeping your login credentials confidential
- Using a strong, unique password
- Not sharing your account or credentials with anyone
- Logging out of shared or public devices
- Immediately reporting any suspected unauthorized access to your account
2.3 Account Responsibility
You are responsible for all activities that occur under your account. If you suspect unauthorized use of your account, notify Your Organization's administrator and contact us immediately at info@arkfirerms.com.
3. Acceptable Use
3.1 Permitted Uses
You may use the Services only for legitimate fire department, emergency services, and related administrative purposes as authorized by Your Organization.
3.2 Prohibited Conduct
You agree NOT to:
- Compromise Security: Attempt to gain unauthorized access to any systems, accounts, or data; probe or test vulnerabilities; or bypass security measures
- Share Credentials: Share your login credentials with anyone, including other members of Your Organization
- Access Unauthorized Data: Access or attempt to access data belonging to other organizations or users without authorization
- Interfere with Service: Take any action that disrupts, damages, or impairs the Services or servers
- Reverse Engineer: Decompile, disassemble, reverse engineer, or attempt to derive source code from the Services
- Scrape or Harvest: Use automated means to collect data from the Services without permission
- Violate Laws: Use the Services for any illegal purpose or in violation of applicable laws
- Transmit Malware: Upload or transmit viruses, malware, or other harmful code
- Impersonate Others: Impersonate another person or entity, or falsely represent your affiliation
- Harass Others: Harass, threaten, or abuse other users
- Misuse Data: Use information obtained from the Services for purposes other than Your Organization's legitimate business needs
4. Data Entry and Accuracy
4.1 Your Responsibility
You are responsible for the accuracy, completeness, and legality of data you enter into the Services. You agree to:
- Enter information accurately and truthfully
- Correct errors promptly when discovered
- Not enter false, misleading, or fraudulent information
- Follow Your Organization's policies for data entry
4.2 Sensitive Information
If you enter protected health information (PHI), personally identifiable information (PII), or other sensitive data, you must:
- Follow applicable laws and regulations (including HIPAA if applicable)
- Comply with Your Organization's data handling policies
- Only access sensitive data when necessary for your job duties
4.3 Reporting
Report any data quality issues, security concerns, or suspected breaches to Your Organization's administrator immediately.
5. Privacy
5.1 Privacy Policy
Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and protect information.
5.2 Consent
By using the Services, you consent to the collection and processing of information as described in our Privacy Policy.
5.3 Activity Logging
We log user activity within the Services for security, auditing, and troubleshooting purposes. Your Organization's administrators may have access to activity logs.
6. Intellectual Property
6.1 Our Rights
The Services, including all software, content, designs, trademarks, and documentation, are owned by ARK Fire RMS and protected by intellectual property laws. Nothing in these Terms grants you ownership of any intellectual property.
6.2 Restrictions
You may not:
- Copy, modify, or distribute the Services or any part thereof
- Remove or alter any copyright, trademark, or other proprietary notices
- Use our trademarks without written permission
6.3 Feedback
If you provide suggestions, ideas, or feedback about the Services, we may use such feedback without any obligation to you.
7. Third-Party Services
The Services may integrate with or link to third-party services. We are not responsible for third-party services, and your use of them is subject to their own terms and policies.
8. Disclaimers
8.1 As-Is Basis
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
8.2 No Professional Advice
The Services are tools to assist Your Organization with record management and administration. They are not a substitute for professional judgment, training, or established emergency response protocols. You are responsible for your own decisions and actions in emergency situations.
8.3 Availability
We do not guarantee that the Services will be available at all times or without interruption. The Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARK FIRE RMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
Our total liability to you for any claim arising from these Terms or your use of the Services shall not exceed one hundred dollars ($100).
10. Termination
10.1 By Your Organization
Your Organization's administrators may suspend or terminate your access to the Services at any time.
10.2 By Us
We may suspend or terminate your access if you violate these Terms, engage in prohibited conduct, or as required to comply with law.
10.3 Effect of Termination
Upon termination, your right to access the Services ceases immediately. Provisions that by their nature should survive termination (including Sections 6, 8, and 9) will continue to apply.
11. Changes to Terms
11.1 Updates
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. For significant changes, we may provide additional notice (such as an in-app notification).
11.2 Continued Use
Your continued use of the Services after changes become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.
12. General Provisions
12.1 Governing Law
These Terms are governed by the laws of the State of Nebraska, without regard to conflict of law principles.
12.2 Entire Agreement
These Terms, together with the Privacy Policy and any agreements between Your Organization and ARK Fire RMS, constitute the entire agreement regarding your use of the Services.
12.3 Severability
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect.
12.4 Waiver
Our failure to enforce any provision does not constitute a waiver of that provision.
12.5 Assignment
You may not assign your rights under these Terms. We may assign our rights to any successor in interest.
